Each migrant camp must meet specific standards in order to qualify for certification.
Wisconsin's migrant labor laws require all migrant labor camps to be certified by DWD. Tragically, this discussion focuses on a devastating incident in which a child lost their life due to an accident on a farm, shedding light on the urgent need to address the safety and well-being of young workers in the agricultural industry.

Eight year old migrant worker allegedly trampled by his father driving a skid steer (machine used to scoop manure). This was a police report. Because [the boy] was not a worker, the investigator was told, OSHA likely would not investigate. His father brought him here from Nicaragua, desperate to earn money to support his family.

Previously, state officials noted manure on the walls and cows with dirty flanks and udders, signs that the milk was at risk of becoming contaminated.</text>

2017 Public Safety Omnibus bill: Laws of Minnesota 2017, chapter 95, article 3, section 5 - Would allow undocumented immigrants to apply for driver's licenses to work.

1977 Minnesota’s Alien Farm Law: Minnesota Statutes Section 500.221 - Allows for Immigrants to stay in Minnesota under certain guidelines.

Minimum Wage Law

Minnesota has a state minimum wage law: The current minimum wage is $10.59 an hour for large employers and $8.63 an hour for small employers.

Agricultural workers are not included under the definition of ‘employee”, therefore, they are exempted from the state minimum wage law. Meaning many migrant workers would sometimes get paid even less than the minimum wage on the farms they work for.

Payment terms

Each migrant worker who is recruited by an employer is entitled to payment in accordance with this section. (Sec, 181.87 MN Statutes(Subd. 1))

Biweekly pay. The employer shall pay wages due to the migrant worker at least every two weeks, except on termination, when the employer shall pay within three days. (Sec, 181.87 MN Statutes(Subd. 2.))

Overtime Pay

The employer shall guarantee to each recruited migrant worker a minimum of 70 hours pay for work in any two successive weeks and, should the pay for hours actually offered by the employer and worked by the migrant worker provide a sum of pay less than the minimum guarantee, the employer shall pay the migrant worker the difference within three days after the scheduled payday for the pay period involved.(Sec, 181.87 MN Statutes(Subd. 3))

Worker fired or quits.

Under Minnesota State Law: If the migrant worker quits or is fired for cause prior to the completion of the operation for which hired, the migrant worker is entitled to no further guarantee under subdivision 3 from that employer. If the migrant worker quits or is fired for cause before the completion of a two-week pay period, the worker is entitled to no guarantee for that period. (Sec, 181.87 MN Statutes(Subd. 4))

After being fired/quitting, the employer can require the migrant worker to vacate the provided housing on final payment of all wages.
